The Sec of State has already indicated that there is nothing to object to by not calling the plans in.
C&R are asking for a judicial review on the grounds of (in their opinion) "flawed planing process".
Indeed the reason the process was so drawn out was mainly to do with tying up all the loose ends and making sure that all objections were heard and that it would not be open to legal challenge.
However - large companies (like Tesco) using their weight to bash Council planning departments into submission is a normal part of corporate dedication to greed over any needs of the local community.
These latest published statements beg a few questions:
"A further media statement released by The Mall owners yesterday reiterated their intentions and stated: ‘Capital & Regional remains entirely supportive of the plans for the new Luton Town stadium on the Power Court site in Luton town centre.'
'We have repeatedly offered support to 2020 Developments in this regard, which has yet to be taken up.’(1)
The statement went on to add: ‘Our legal advice (2) is that the way this consent was delivered was legally flawed. We are entitled to exercise our legal right to challenge this.'
‘There are plenty of ways to fund the new stadium without building an inevitable rival to the already struggling town centre. It is just a matter of record that no out of town retail/leisure development has ever saved a struggling town centre."(3)
1) - OK - put up the £40 million required then C&R - or shut up about how supportive you can be...
2) legal advisers will always advise their rich clients to spend more money on legal fees - what a surprise. - it almost certainly was not legally flawed.
3) setting aside Cabot circus and Cribbs Causeway - inner and out of town developments in Bristol -
saying something is "just a matter of record" because it has supposedly never been done is a nonsense statement.
- Much more pertinent is that no tight fisted Mall based operation has ever saved a town centre by refusing to invest in it for decades but instead spent time and money complaining about anyone else that comes along with a plan to do just that.
C&R appear very childish and are damned as such by Shuker MP's letter to their CEO...
